1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from Raspe GmbH Uhren & Goldschmiede to consumers.

3. Offer and Conclusion of Contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. All offers are valid "while stocks last", unless otherwise noted for the products. Errors excepted.

3.2 By clicking the "Buy" button in the last step of the ordering process, you place a binding order for the goods contained in your shopping cart. The purchase contract is concluded when we accept your order by an order confirmation via e-mail immediately after receiving your order.

5. General

General http://www.raspe-uhren-schmuck.ch is a comprehensive portal for the online sale of watches and jewelry. It is our endeavor to always serve you to your complete satisfaction. This also includes our fair business conditions. We only deliver high-quality products. The contract is concluded when we accept your contractual offer, made by your order, with our order confirmation and send you an order confirmation directly online. Refusal of Acceptance

In case of unjustified refusal to accept the goods delivered by us, we will charge you for the costs incurred; in case of repeated refusal of acceptance, you will be blocked from our offer.

Data Protection

http://www.raspe-uhren-schmuck.ch only collects strictly necessary personal data and uses it within the framework of order/payment processing. Personal data is treated as absolutely confidential by http://www.raspe-uhren-schmuck.ch in accordance with data protection legislation. We use your existing data exclusively for processing your order. We do not pass on your personal data, including your home and e-mail address, to third parties. This excludes our service partners who require the transmission of data for order processing (e.g. the shipping company commissioned with delivery and the credit institution commissioned with payment processing). In these cases, however, the scope of the transmitted data is limited to the necessary minimum.

Delivery Conditions

Goods are generally only delivered to the orderer/customer after receipt of payment. Delivery is made by post/courier. To deliver the goods as quickly as possible, we also make partial deliveries. You will not incur any additional costs as a result. For goods exported abroad, additional shipping and customs costs may apply. These must be borne by the customer.

Warranty Certificate

Warranty service may vary depending on the item offered. If a warranty promise is declared in the detailed product information, we ask you to check the warranty promise (warranty certificate) upon receipt of the goods. A validly issued warranty certificate for branded products entitles you to receive the warranty service (according to the warranty description) from any declared brand dealer. If no warranty is declared, you are not entitled to this service.

Exchange / Right of Return

Items can be exchanged or returned without reason within 14 days. You will receive the full purchase price back. Excluded are engraved items and rings that have been made to a specific size. The items must be undamaged and unworn in their original condition. You will receive a receipt from the post office when you send the package. Please keep this safe, because in case of a lost package, your return can only be credited upon presentation of this receipt – provided the package was returned by registered mail. The costs for the return are at your expense. We reserve the right to deduct additional costs incurred from the purchase amount (e.g. customs costs, fees, etc.). Please also note that a restocking fee of 10% of the purchase amount will be charged for postage, shipping and restocking efforts.

Applicable Law and Place of Jurisdiction

Swiss law shall apply exclusively. The place of jurisdiction for all disputes shall be the judicial district of Bern-Mittelland, 3008 Bern, unless another place of jurisdiction is mandatorily prescribed by law.

6. Prices and Shipping Costs

6.1 The prices stated on the product pages include the statutory VAT and other price components. Price changes and errors are reserved at all times.

6.2 Shipping costs depend on the quantity of goods ordered and the shipping method and will be clearly communicated to you before you place your binding order.

6.3 For goods exported abroad, additional shipping and customs costs may apply. These must be borne by the customer.

7. Delivery

7.1 If the item is in stock (dispatch within 1-3 days), the delivery time is usually 1-3 working days plus the usual postal transit time. Intermediate sales are reserved. For items not in stock (dispatch after 3-6 days), the delivery time depends on the supplier. We will inform you about this by email as soon as possible.

7.2 Should the ordered product not be deliverable in time because we are not supplied with this product by our supplier in time, we will inform you immediately. In such a case, you are free to wait for the ordered product or to cancel your order. In case of a cancellation, any consideration already rendered will be refunded immediately.

8. Payment

8.1 Payment is made by prepayment/PayPal/credit card/Postfinance.

8.2 If you select the prepayment option, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.

9. Retention of Title

The goods remain our property until full payment.

10. Warranty / Liability

For the delivered goods, liability is limited to a replacement delivery. Claims for rescission of the contract or reduction of the remuneration are excluded, provided that a replacement delivery is possible within a reasonable period. Objections due to defects in the goods can be made within 5 working days. If an inspection of the defective goods shows that the defects are due to culpable conduct of the buyer (e.g. damage due to improper handling), the buyer shall bear the costs of the replacement delivery. Our liability for our own fault is limited to intent and gross negligence. This does not apply to the violation of essential contractual obligations and the absence of assured properties.
